Subscriber Agreement

Subscriber Organizations are required to develop written subscriber agreements that include specific terms and conditions for subscriptions. These agreements should include: project information, effective dates, charges and fees, payment details, bill credit mechanisms, service terms, customer protections, and contact information. Additionally, subscriber agreements must incorporate all bid commitments for the relevant project. For example, if a project committed to not requiring credit checks, the subscriber agreement must match that commitment.

Please note that subscriber agreements provided during the bid process were not reviewed for approval by the Program Administrator. Subscriber Agreements may be subject to audits to ensure compliance with program rules and bid commitments.

Complaint Resolution

Any complaints about a Subscriber Organization or Subscriber Organization’s affiliate received by the Program Administrator will be referred to the applicable Subscriber Organization for resolution. The Subscriber Organization must investigate each complaint and provide a written response to the complainant and to the Program Administrator.

If the Subscriber Organization is unable to resolve the complaint, the Program Administrator may escalate the complaint to the Public Regulation Commission’s Consumer Relations Division for informal resolution. Serious issues may be referred to the Office of the Attorney General for the state of New Mexico.

Consumer Protection Best Practices

This document provides best practices and recommendations to Subscriber Organizations regarding consumer protection and subcontractor management. While the items in this document are not program requirements (unless otherwise indicated), they are good business practices. Subscriber Organizations are strongly encouraged to adopt them to ensure that consumers are adequately informed about their subscription contracts and that each Subscriber Organization adequately manages all subcontractors working on its behalf.
